Training regulations

GENERAL PROVISIONS

  1. Whenever the provisions of the Regulations refer to: 
  2. Terms and Conditions - means this document and all its provisions;
  3. Organizer - it shall be understood as the company Akademia Beauty Zoom N. Koziróg-Şahin, M. Zduńczyk S.C. at ul. Grzybowska 80/82, 00-844 Warsaw, with NIP:7011047285, REGON number 389612859, which is the organiser or co-organiser of the training course. Beauty Zoom Academy is entered into the Central Register of Business Activity and Information and the Register of Training Institutions kept by the Regional Labour Office in Warsaw under no. 2.14/00327/2021.
  4. Personal Data Administrator - means the Organiser;
  5. Training - means a training or course organised or co-organised by the Beauty Zoom Academy.
  6. Participant / Trainee - means a person wishing to enrol / enrolled in a training course
  7. User - means the user of the Website or the Online Shop;
  8. Model - means the person for whom the service or treatment will be performed, during the training .
  9. These Terms and Conditions shall apply to contracts concluded via the website and/or online shop, face-to-face at the place of training, by telephone and by e-mail.
  10. Payment for training, enrolment as a model, as well as use of the website and/or online shop signifies that the persons concerned have read and accepted these terms and conditions.
  11. The Participant, Model and User declare that no claims will be made against the organiser on account of the provisions of these rules.
  12. All content available on the website and online shop, as well as all social networks administered by the Organiser, including in particular the offer of training, online training and courses, the description of training and courses, the training programme, opinions, photos, graphics, videos, rules and regulations, privacy policy, etc., are the intellectual property of the Organiser and as such are subject to protection in accordance with the Act on "Copyright and Related Rights" of 4.02.1994, Dz. U. nr 24 poz. 83 with later amendments. All rights reserved.
  13. Violation of copyright law is punishable by a financial penalty of 50 .000 PLN (in words: one hundred thousand PLN) for each violation. The Participant, Model and User declare that they will voluntarily submit to pay the aforementioned financial penalty in the event that they infringe the aforementioned law.
  14. Participants of all courses and trainings organised by the organiser Beauty Zoom Academy declare that they will not record, reproduce, capture or disseminate them in any form, especially in the form of photographs and recordings. All training materials are the intellectual property of their creators, are protected by copyright and made available to participants for private use only. A breach of this prohibition is subject to a financial penalty of PLN 50,000 (in words: fifty thousand zloty). Training materials may not be sold, resold or made available to the public to persons not participating in the courses or training. A breach of this prohibition may result in a financial penalty of PLN 50,000 (in words: fifty thousand zloty).

CONDITIONS FOR PARTICIPATION

  1. The conditions of participation in the training are: 
  2. Application for participation in the training can be made by sending information to the following address akademiabeautyzoom@gmail.com or by telephone.
  3. Payment within 7 days of the initial booking - an amount of 20% of the service price, as a deposit. The payment should be made to the Organiser's bank account.
  4. The application for participation in the training as a model/model, is tantamount to the payment of a deposit of 20% of the value of the service.
  5. The remaining amount should be paid on the day of the course at the latest. The trainee is obliged to provide the data necessary for a VAT invoice (name, address, VAT number, contact telephone number, email address).
  6. Participants are required to familiarise themselves with these Regulations prior to the start of the training or service.

CANCELLATION OF TRAINING

  1. The trainee has the right to withdraw from the training course without giving any reason.
  2. The deposit paid by the student is forfeited:
  3. in the event of cancellation of a course less than 7 days before its scheduled start date
  4. in the event of the Trainee's absence from the training service paid for by the Trainee, which is tantamount to withdrawal from the training course.
  5. In the case of payment in full 7 days before the start of the training course and the decision of the Student to withdraw from participation, the Organiser shall not refund the payments made for the service.
  6. In the event that the Trainee resigns from the training course during its duration, the Organiser shall not return the payments made for the training course .
  7. In case of cancellation as a model/model less than 3 days before the scheduled start date of the training, the deposit paid will be forfeited.

COMPLAINTS

  1. The Participant/Trainee/Model has the right to lodge a complaint regarding the way in which the training is delivered, the quality of the service provided or any discrepancies in the training materials provided, provided that the non-compliance relates to the elements expressly stated in the training offer.
  2. The complaint should be made in writing via email sent to: akademiabeautyzoom@gmail.comno later than 7 calendar days from the date of completion of the training course. Complaints submitted after this date will not be considered.
  3. A properly submitted complaint must include:
  4. the name of the person making the complaint,
  5. the date and name of the training,
  6. detailed description of the objections,
  7. documentation proving the validity of the complaint (if applicable),
  8. specify the claim of the person making the complaint.
  9. The organiser undertakes to handle complaints within the following deadlines 14 working days from the date of receipt of the complete complaint notification. Failure to reply within this period shall mean rejection of the complaint.
  10. The organiser reserves the right to:
  11. reject complaints that do not meet formal conditions,
  12. not to accept a complaint if it concerns subjective issues or issues unrelated to the performance as offered.
  13. In particular, the following are not subject to complaint:
  14. the participant's individual, subjective feelings about the level of the training, the pace of the trainer, the way the class was conducted or the atmosphere,
  15. Lack of practical effects due to the lack of involvement of the Trainee or lack of independent work after the training,
  16. fortuitous, technical or health situations on the part of the Trainee (e.g. tardiness, non-attendance, inability to complete the training),
  17. withdrawal from the contract or absence without observance of the terms and conditions set out in these Regulations,
  18. a change of mind about attending a training course after it has started,
  19. differences between the Participant's expectations and the training programme, if the programme has been made available in advance.
  20. If the complaint is found to be valid, the Organiser may offer one of the following forms of compensation:
  21. partial reimbursement of the amount paid,
  22. the possibility of repeating part of the training at no extra charge,
  23. another form of termination agreed individually with the Participant.
  24. Filing a complaint shall not suspend the obligation to pay for the training nor does it constitute grounds for withdrawal from the contract itself.

OBLIGATIONS OF THE PARTIES

1 The customer has the right to expect that:

  • comfortable working conditions will be provided,
  • the trainer will have factual and practical knowledge of the subject matter of the service to be provided,
  • the substantive and practical scope will be realised during the service,
  • the company fulfils the formal conditions for participation in the service and the concluded contract, including the issuing of course materials and certificates.
  • The company will fulfil all formal conditions for participation in the service and the provisions of the concluded contract, including the provision of training materials and a certificate of completion.
  • To receive the certificate, 100% attendance and active participation in the practical and theoretical parts of the training is a prerequisite. The participant should also demonstrate the acquisition of the basic skills covered in the training programme.

(2) The organiser has the right to expect that:

  • The trainee will fully engage in the service process and actively participate in the exercises,
  • The trainee(s) will comply with the rules established during the service,
  • The student will arrive on time and participate in the entire scheduled service,
  • In the case of EU-funded projects, the trainee will complete all the formalities provided for in the project regulations.

3 Responsibilities of the Organiser:

  • The organiser undertakes to use its best endeavours and to perform the services with due diligence in accordance with the accepted offer and contract,
  • The organiser provides all materials for the service, including a script, slides and models,
  • in the event of unforeseen situations, the Organiser will take immediate action in accordance with established procedures.


PROTECTION OF PERSONAL DATA


  1. The organiser is the administrator of the personal database of the Course participants.
  2. The Trainee(s) agrees to make his/her personal data available to the Organiser, which will be processed for purposes related to the organisation of the service and the performance of the concluded agreement, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (RODO).
  3. Consent to the recording and use of the Student's image (e.g. in photographs of the service or examination) is entirely voluntary and is not a condition for participation in the training course. If granted, this consent includes the free use of the image by the Organiser.
  4. The image may be used by the Organiser in the following fields of exploitation: print (in any number of publications and circulation), the Internet (website, social media) and other forms of recording, exclusively for purposes related to the Organiser's educational and promotional activities.


FINAL PROVISIONS

  1. In matters not covered by these Terms and Conditions, the relevant provisions of Polish law shall apply, in particular the Civil Code, the Act of 18 July 2002 on the provision of electronic services and other relevant provisions of Polish law.
  2. The competent court for any disputes related to the performance of the agreements concluded on the basis of these Regulations shall be the court according to the seat of the Organiser.
  3. Participant, User and Model are bound by the above Rules.
